A public interest litigation (PIL) has been filed in the Allahabad High Court, seeking the removal of Uttar Pradesh Chief Minister Yogi Adityanath. The petition, submitted by the People's Union for Civil Liberties (PUCL) through Advocate Seema Srivastava, alleges that Adityanath violated his constitutional oath by endorsing controversial statements made by Justice Shekhar Kumar Yadav at a Vishwa Hindu Parishad (VHP) event in Prayagraj on December 8.
Justice Yadav, during his speech at the VHP event, asserted that a nation's laws should reflect the will of its majority population. He further used derogatory terms when referring to the Muslim community, sparking widespread criticism for promoting majoritarian views and communal bias.
Chief Minister Adityanath publicly supported Justice Yadav's remarks during the World Hindu Economic Forum 2024 in Mumbai on December 14. He criticized opposition parties for seeking the judge's impeachment and advocated for the implementation of a Uniform Civil Code (UCC), suggesting that governance should align with the majority's preferences. Adityanath reiterated his stance in the Uttar Pradesh Assembly on December 16, defending the judge's statements as truthful and condemning attempts to intimidate him through impeachment threats.
The PUCL's petition contends that Adityanath's endorsement of Justice Yadav's comments undermines the secular fabric of the Indian Republic and constitutes a breach of constitutional principles, including fraternity, secularism, and equality. The PIL argues that such actions erode public faith in the Constitution and warrant the Chief Minister's dismissal.
