Delhi High Court Declines to Classify Ram Janmabhoomi Trust as Public Authority

The Delhi High Court has declined to entertain a petition seeking to designate the Shri Ram Janmbhoomi Teerth Kshetra Trust as a public authority under the Right to Information (RTI) Act. The court advised the petitioner, Neeraj Sharma, to approach the Central Information Commission (CIC) for a resolution.

Sharma's petition challenged the CIC's July 8, 2022, decision, which denied his request for details about the Trust's Central Public Information Officers and First Appellate Authority. The Ministry of Home Affairs (MHA) had previously stated that the Trust is an independent and autonomous organization, neither owned, controlled, nor financed by the Government of India, and therefore falls outside the RTI Act's definition of a public authority.

During the hearing, Justice Sanjeen Narula suggested that Sharma seek judicial review by the CIC itself. Additional Solicitor General Chetan Sharma, representing the MHA, did not oppose this course of action. Consequently, the court directed Sharma to present his case before the CIC for further consideration.
