Thirteen senior advocates have formally requested Chief Justice of India (CJI) Sanjiv Khanna to direct the Central Bureau of Investigation (CBI) to register a First Information Report (FIR) against Justice Shekhar Kumar Yadav of the Allahabad High Court.
The advocates' letter highlights a speech delivered by Justice Yadav at a Vishva Hindu Parishad (VHP) event on December 8, 2024, within the Allahabad High Court library premises. They allege that his remarks were communal and violated the constitutional oath of impartiality.
In their communication, the advocates emphasize the necessity of judicial neutrality, stating that Justice Yadav's comments undermine the secular fabric of the nation. They reference the Supreme Court's ruling in *K. Veeraswami v. Union of India* (1991), which mandates consultation with the CJI before initiating any criminal proceedings against a sitting judge.
